The 52nd Regular Session of the Human Rights Council (HRC52) took place in Geneva and online from 27 February to 4 April 2023. This page highlights the environmental-related activities of this session.

The Human Rights Council today concluded its fifty-second regular session after adopting 43 resolutions, extending 19 thematic and country-specific mandates, and appointing 10 Special Procedure mandate holders. The next session of the Council will take place from 19 June to 14 July 2023.

Highlights from the Opening of the 52nd Session

The high-level opening segment of HRC52 highlighted strengthened links among human rights and the environmental crisis we face today, particularly in relation to climate change and the human right to a clean, healthy and sustainable environment. Approaching these from the perspective of human rights is crucial if we are to address such challenges. The President of the UN General Assembly pointed out,

I call for a fundamental change of how we manage interlocking crises… Climate change, the crisis of this generation, threatens human rights to water and sanitation, food, health, and adequate housing and even self-determination. It already threatens the right to life of many. Integrating the grim reality of climate change with the insecurity of human rights, the General Assembly, following the lead of this Council, recognized that a clean, healthy, and sustainable environment is a human right.

He also called on the Council, despite differences on views on the right to a clean, healthy and sustainable environment among Member States, to further the discussions. “After all, all human rights have their origin in political recognition.

2023 also celebrates the 75th anniversary of the Universal Declaration of Human Rights (UDHR), which described for the first time, entitlements that applied to everyone, everywhere, always. The UN Secretary-General also remarked that as the Universal Declaration is under assault from all sides, now is the time to “revitalize the Declaration and ensure its full implementation to face the new challenges of today and tomorrow.”

High-Level Segment on the Right to Development

On the occasion of the thirty-fifth anniversary of the Declaration on the Right to Development, the Human Rights Council decided to convene at HRC52 a full-day high-level meeting, in a hybrid format and fully accessible to persons with disabilities, with sign language interpretation and webcast, on the promotion and protection of the right to development (A/HRC/49/8). The panel emphasized on the importance of the mandate of the UN High Commissioner for Human Rights with regard to the promotion and protection of the realization of the right to development, while fully recognizing its distinct nature and intrinsic value. The high-level segment took place from 28 February to 1 March.

Right to a Clean, Healthy and Sustainable Environment

The United Nations General Assembly‘s historic decision in July 2022 to recognize that everyone has the right to a clean, healthy and sustainable environment has placed this landmark recognition at the forefront of the human rights agenda, following the same recognition by the Human Rights Council in October 2021. Not only is this a catalyst for accelerated action to tackle the triple planetary crisis, but it also places our attention on people and communities in vulnerable situations.

Women, girls and the right to a clean, healthy and sustainable environment

The right to a clean, healthy and sustainable environment is discussed at the March session of the Human Rights Council. As part of the mandate of the Special Rapporteur on human rights and the environment, David Boyd presented his annual report to the Council on women, girls and the right to a clean, healthy and sustainable environment (A/HRC/52/33) at this session.

An interactive dialogue with the independent expert to discuss this report, alongside the outcomes of his country visits to Portugal (A/HRC/52/33/Add.1) and Slovenia (A/HRC/52/33/Add.2), took place on 9 and 10 March 2023, with over 100 interventions from States, UN agencies and civil society.

Climate Change and Human Rights

Climate change is an existential threat for people and the planet. Its harmful effects undermine the full enjoyment and realization of all human rights, disproportionately affecting those who are already in vulnerable situations. Over the past years, the Human Rights Council took on resolutions and discussions on specific aspects of climate change, with Special Rapporteurs contributing reports on specific thematic angles within their mandates. → Find more information on HRC resolutions on climate change

Climate crisis and the right to adequate housing

As part of the mandate of the Special Rapporteur on adequate housing as a component of the right to an adequate standard of living, and on the right to non-discrimination in this context, Balakrishnan Rajagopal presented his annual report to the Council, “Towards a just transformation: climate crisis and the right to housing” (A/HRC/52/28).

The report highlights the severe threat the climate crisis poses to the enjoyment of the right to adequate housing around the world, where marginalized groups are at particular risk. On the other hand, the report also acknowledges that housing itself makes a significant contribution to climate change, through housing construction, urban sprawl, soil sealing, energy consumption, water use, pollutants, deforestation, desertification and loss of biodiversity. As such, “a timely and well-devised intervention in the housing sector is therefore necessary.”

It is imperative to achieve a just transition towards rights-compliant, climate-resilient and carbon-neutral housing. International cooperation, financial support and significant investments are necessary to support this transition, including the creation of a fund to support climate mitigation and adaptation measures in the housing sector for those developing countries that are particularly vulnerable to the adverse effects of climate change. A just transition must also entail international remedies and compensation for climate-induced loss and damage in the area of housing.

OHCHR Report on Panel discussion on the adverse impact of climate change on the full and effective enjoyment of human rights by people in vulnerable situations

In its resolution 47/24, the Human Rights Council requested OHCHR to submit to the Council, at its fifty-second session, a summary report on the panel discussion on the adverse impact of climate change on the full and effective enjoyment of human rights by people in vulnerable situations, held at its fiftieth session. The Council had before it the report of OHCHR (A/HRC/52/48).

IPCC Synthesis Report from a Human Rights Perspective

On 20 March 2023, the IPCC presented the AR6 Synthesis Report (SYR), following its 58th session in Interlaken (13-17 March 2023). The content of the SYR has important implications for the protection of human rights, as it will inform States’ measures to mitigate and adapt to climate change. States have the obligation to take measures to address climate change that ensure an effective promotion, protection, and respect of human rights.

This side event by CIEL and Earthjustice assessed the IPCC Synthesis Report through human rights lenses, in order to understand how its messages about the gravity of the climate crisis, and the urgency to take effective and rapid action to tackle it can promote rights-based climate action. → Revisit the highlights, or rewatch the livestream.

Environmental Human Rights Defenders

Environmental human rights defenders (EHRDs) are those who strive to protect, promote and safeguard a clean, healthy, and sustainable environment, as recognized in HRC Resolution 40/11. From the local to the international level, the efforts of EHRDs have provoked responses to the three interlinked environmental crises afflicting our planet – the loss of biodiversity, pollution, and climate change. However, evidence suggests that they remain highly vulnerable and under attack across the globe.

25 years of achievements by human rights defenders

In her annual report to the Council, the Special Rapporteur on the situation of human rights defenders, Mary Lawlor, takes stock of the 25 years that have passed since the adoption of the Declaration on the Right and Responsibility of Individuals, Groups and Organs of Society to Promote and Protect Universally Recognized Human Rights and Fundamental Freedoms (Declaration on Human Rights Defenders, A/RES/53/144), and highlights examples of achievements and success stories that human rights defenders have shared with her.

The report includes examples of accessing justice, changing laws, protecting the vulnerable and holding businesses to account. The report offers a change in focus from the violations committed against human rights defenders to their often uncredited successes.

Environmental human rights defenders also feature in the report, particularly in the context of holding businesses accountable:

Human rights defenders have secured striking victories for their communities in the face of environmental degradation, attempts to remove them from their land and the exploitation of natural resources without the consent of those affected.

This is even more so for indigenous human rights defenders, who are often most at risk of being killed.

In her recommendations, she calls upon States to “ensure that human rights defenders are consulted as part of any meaningful human rights and environmental due diligence process.”

Geneva Roadmap 40/11 | Protecting Environmental Defenders

The Geneva Roadmap 40/11 on the protection of the rights of persons engaged in the defense of the environment seeks to ensure the effective implementation of the right to act for the protection of the environment and to promote free and safe spaces for information and discussion on environmental matters.

A side event to HRC52 on “Protecting Environmental Defenders” discussed the steps made since the launch of the “Geneva Roadmap 40/11” in 2020 in the protection of environmental defenders and identify objectives to come. → Revisit the outcomes, or rewatch the livestream.

Conflict and the Right to Food

As part of his mandate as the Special Rapporteur on the right to food, Michael Fakri presented to the Council an annual report that gives an account of how different forms of violence in food systems harm people and generate the conditions that lead to human rights violations.

The report makes clear that “violence in food systems has increased in recent years owing to the interdependence of various factors affecting global food security.” Rural communities who have already have to confront land-grabbing by powerful businesses are also “severely affected” in recent years by drought and climate change. As our current food systems rely on a global economy of dependency and extractivism, the report highlights how “industrial food systems have a massive environmental impact and violate the rights to life, health, water, food and the enjoyment of a safe, clean, healthy and sustainable environment.

The problem is commonly framed as a technical matter, a lack of effective environmental policies that require the careful management and use of natural resources. The Special Rapporteur, however, emphasizes that food systems are undermining people’s relationship with the environment, leading them to disassociate from and destroy the very same ecosystems that sustain them. Recognizing this dynamic as ecological violence highlights the fact that environmental harm cannot be separated from human harm. The world must move away from an extractive economy and dependent relationships.

In this light, the independent expert calls upon a shift to agroecology, making clear recommendations on how to tackle the ecological violence that occurs due to dependent and extractivist food system:

  • Respect, protect and guarantee land rights and enact genuine agrarian reform by enacting laws and policies;
  • Reaffirm that farmers’, Indigenous peoples’ and workers’ rights are human rights; and
  • With regard to seeds, base their national seed systems on the International Treaty on Plant Genetic Resources for Food and Agriculture and human rights law.

The Special Rapporteur presented his report in an interactive dialogue with Member States on 9 March 2023.

Plastics and Human Rights

During the General Debate on Agenda Item 3 on 17 March 2023, the Permanent Representative of Peru, on behalf of Peru and 32 other countries, delivered a statement underscoring that “The impact of plastic pollution on a broad range of human rights is undeniable.” The statement urges Member States to call for a plastics treaty firmly rooted in a human rights-based approach that reduces inequalities, enables just transition, and protects the environment.

On the occasion of International Women’s Day 2023 on 8 March, this event celebrated the key role women and girls play in the fight against the triple planetary crisis. The event also had the Special Rapporteur on human rights and the environment, David Boyd, who spoke more about his latest report to the Human Rights Council.
