About this Event

As demonstrated in the report of the UN Special Rapporteur on the right to a clean, healthy and sustainable environment to the 61st session of the UN Human Rights Council (HRC61), air pollution has become an unequivocal risk for human rights. 

Shockingly, nearly 99% of the global population still lack access to clean air. Air pollution knows no borders, creating transboundary impacts, while systemic inequalities, climate change, ecosystem degradation, nature loss and toxic pollutants further exacerbate these harms. Clean air is therefore a core component of the human right to a clean, healthy and sustainable environment, and is indispensable for the enjoyment of all human rights, including the rights to life and to health. 

This Geneva Rights and Environment Talk, organized in parallel with the Council, followed up on the Interactive Dialogue at the Human Rights Council on the Special Rapporteur’s report of Friday 6 March, as well as on her presentation at the associated side event on Monday 9 March. It focused on practical ways to address cumulative sources of pollution and to prioritize action in areas with persistent noncompliance. The discussion highlighted the importance of transparency and public oversight, and the need for air quality policies, laws, regulations, and actions to fully integrate a human rights-based approach. This includes recognizing the severe health risks posed by air pollution, ensuring that responses are comprehensive and effective, and addressing the needs and protection of the most vulnerable populations.

About the Geneva Rights and Environment Talks

In the face of the three interrelated environmental crises — climate change, loss of biodiversity, and pollution — the recognition of the right to a clean, healthy, and sustainable environment by the UN Human Rights Council and the UN General Assembly is an important milestone that puts environmental issues at the forefront of the human rights agenda.

The Special Rapporteur on the human right to a healthy environment reports to the Human Rights Council during its March session on issues related to their mandate. The Geneva Rights and Environment Talks aim to harness the opportunity of this moment of the year to reflect on the challenges posed by the rapid decline of nature and biodiversity and the intertwined human rights implications. The talks are also an opportunity to discuss how Geneva contributes to bringing together the actors working towards ensuring the right to a clean, healthy, and sustainable environment is upheld for all.

Astrid PUENTES RIAÑO | UN Special Rapporteur on the Right to a Healthy Environment

  • Clean air is literally in every single breath that we take, and it is not something that we are advancing.
  • There is a lot of science on this issue, and we are going to hear more about that today, but there are also many obstacles.
  • It is important to understand that thinking about clean air and air quality is a human rights issue, and that is one of the main things that I wanted to advance and remind us of with this report.
  • My predecessor, David Boyd, prepared a report in 2019 about clean air as part of the human right to a healthy environment. But we need to continue understanding this, not only from a legal or academic perspective, but also from what is happening on the ground, because today the numbers are worse.
  • Even after the report from my predecessor and other reports that have addressed clean air, the situation has deteriorated. At the same time, we have seen the express recognition of the human right to a clean, healthy and sustainable environment by the General Assembly, and yet in many ways we are actually going
  • Science has advanced, the legal clarity around the obligations of states, and also of businesses, on what they need to do for clean air has also advanced, but the reality is that we are still going backwards in many respects, and that is very worrisome.
  • I wanted to prepare this report to strengthen the understanding that when we talk about clean air, we are talking about a human rights perspective, but also to clarify what states must do.
  • There is often a question about where to start, and in reality, it is quite simple. You start with your hotspots. If there are situations where pollution is worse, then you prioritize those areas. That means improving air quality monitoring and ensuring better regulation and accountability for businesses. It is not rocket science.
  • We know what the drivers are, and there is extensive data from UNEP, WHO, UNICEF, and many others about the impacts of air pollution.
  • We are developing more and more data about the specific impacts of air pollution on all organs of our body and at all stages of life, so we definitely need to act.
  • From the perspective of the human right to a healthy environment, clean air is one element of that right, but it is also interconnected with other elements, such as a safe climate, healthy ecosystems and biodiversity, and also with procedural rights such as access to information, public participation and access to justice.
  • Two weeks ago, I was in London presenting the report and doing a kind of preview discussion, and we had a conversation with the office of the Mayor of London.
    • They have implemented low-emission zones for several years now, and based on scientific data, particularly the data linking air pollution with children’s health, they have expanded these zones and introduced ultra-low emission zones.
    • The biggest challenge they highlighted is misinformation.
    • It has been very difficult to implement these measures because of misinformation, and I hear this again and again in many cities and countries.
    • Measures that address pollution from private vehicles and transportation are often resisted because people argue that they are defending the economy or private interests.
  • In many countries, one indicator used to measure economic performance is how many cars are being sold. These are the kinds of things that we need to change. We need to put human rights at the center.
  • This means ensuring access to information, participation and justice, but also recognizing the risks that air pollution poses for particularly vulnerable populations, including children, pregnant people, older persons and people living in poverty.
  • Air pollution is increasing inequality. It is also transboundary. During the dialogue at the Human Rights Council, we heard from several states, including the Maldives and the Marshall Islands, who highlighted that they suffer haze episodes that they did not cause. They are experiencing the consequences of pollution originating elsewhere.
  • Today, we also have the advisory opinion from the International Court of Justice, which is very clear about the obligations of states.
    • It states that all states have an obligation to protect the environment and the climate system.
    • This obligation does not arise only from treaties, but also from being part of the international community.
    • States therefore, have an obligation to protect the environment and the climate system and to prevent harm.
  • We already have all the pieces of the puzzle. What we need now is to ensure that these obligations are implemented.

Soraya SMAOUN | Air Quality Coordinator, UN Environment Programme (UNEP)

  • This is a very timely report, and very much welcomed at UNEP. It is a very important contribution to advancing a human-rights-based approach to addressing air pollution. I particularly welcome its focus on the urgency of strengthened action to protect those most affected.
  • In terms of the strategies that UNEP is leading or promoting together with very important partners in this field, I would like to mention a few key points.
  • First and foremost is the need for adequate legislation as a tool to address air pollution. As the Special Rapporteur just mentioned, specialized air quality legislation that protects human health and integrates effective mechanisms for controlling, monitoring and enforcing requirements is integral to enabling states to fulfill their human rights obligations with respect to air pollution.
  • Some of you may be familiar with the Montevideo Environmental Law Programme, for which UNEP acts as the secretariat. Under this programme, we work to deepen the understanding of the challenges in developing strong legal frameworks for air quality and to provide support to Member States to improve their own air quality legislation. We are receiving increasing demand from Member States for that kind of support.
  • I would also like to mention the Global Assessment of Air Quality Legislation that UNEP published in 2021, and we are now considering producing a new one. Some of the findings from that report remain very relevant today. One of the most important conclusions was that the global picture of national air quality laws is highly heterogeneous. Different metrics, standards and obligations are adopted, and different governance actors are involved in air quality regimes. This heterogeneity poses particular challenges, especially for the management of transboundary air pollution.
  • Following that assessment, in 2021, UNEP also developed a guide on ambient air quality legislation aimed at lawmakers. This guide provides step-by-step support to help countries develop effective air quality legislation, and it highlights key criteria for enforcement and compliance as well as procedural rights, including access to information, information dissemination and access to justice.
  • The recommendations in the Special Rapporteur’s report will provide valuable guidance for our work under the Montevideo Programme, particularly in considering how air quality concerns can be integrated into environmental management legislation as a cross-cutting issue.
  • Another key recommendation from the report is the need to reduce pollution at source. UNEP is very active in this field together with partners such as the Climate and Clean Air Coalition, WHO, WMO, and others. We work with governments to identify and monitor the main sources of air pollution. I was very pleased to see that the report includes an extensive analysis of the major sources of air pollution.
  • We support the development of policies and action plans that target high-impact sectors such as industry, transport, agriculture, municipal waste management, and open burning of agricultural residues. These policies and measures should also ensure equitable access to clean air, avoiding discrimination or disproportionate impacts on low-income or marginalized groups, particularly women and children who bear the highest costs of air pollution.
  • A third priority is developing and communicating science. UNEP works to assess health and environmental impacts and to develop digital platforms that help understand the scale of the issue as well as existing policies, standards and success stories.
  • One example is the International Day of Clean Air for Blue Skies, celebrated every year on 7 September, which provides a platform to highlight success stories and solutions.
  • UNEP and the Climate and Clean Air Coalition have also developed a global knowledge platform AQMx. It is essentially a one-stop shop for technical tools, models, data, and knowledge to build capacity among air quality managers worldwide. The platform helps assess actions in key sectors that contribute to air pollution, including industry, transport, and waste management.
  • A fourth area of work concerns engagement with the private sector and with polluting industries, which contribute to the problem but are also an essential part of the solution. UNEP supports the work of the Alliance for Clean Air, which has developed a standardized approach for measuring air pollutant emissions across business value chains based on existing greenhouse gas reporting protocols.
  • We are also implementing a project together with the Clean Air Fund and the United Nations Global Compact to strengthen the capacity of companies to measure, report and reduce air pollution and to advocate for clean air.
  • Related to this is the mobilization of financial resources to address air pollution. This includes integrating clean air considerations into climate planning and elevating the issue within UN country teams and UN development frameworks.
  • Finally, UNEP works to advance international and regional cooperation to address transboundary air pollution. This is another recommendation highlighted in the report. International and regional cooperation has proven to be a very effective mechanism to harmonize air quality standards across subregions and to promote the uptake of solutions.
  • In a nutshell, these are some of the strategies that UNEP and its partners are implementing. We very much welcome the recommendations in this report, and we look forward to continuing to elevate the clean air agenda and to supporting the next steps that emerge from it.

Oksana TARASOVA | Senior Scientific Officer, Infrastructure Department, World Meteorological Organization (WMO)

  • Bringing other dimensions into the air quality agenda is extremely important because what we have seen over time is really a loosening of legislation in many areas.
  • At the World Meteorological Organization (WMO), we work mostly on the technical aspects. Our work focuses on observing the levels of atmospheric concentrations of air pollutants and forecasting how those concentrations change over space and time.
  • The report is very comprehensive and contains relevant information: it aims to build on the science of air pollution, and WMO is one of the leading agencies contributing to the development of this science. We have a programme called the Global Atmosphere Watch programme, which deals with atmospheric chemical composition. This programme looks at the processes that drive changes in atmospheric composition and helps us understand the contribution of different processes.
  • This is important because of the connection between air quality and climate change. These links go in both directions. Climate change itself can drive changes in air pollution by altering meteorological conditions.
  • For example, you can sit in the same valley in Switzerland and, with changes in climate and changes in atmospheric mixing, one valley may experience higher and higher levels of pollution. That is not because emissions have increased, but because the dynamics of the atmosphere have. These aspects need to be taken into consideration. Otherwise, it may appear that people are failing to address pollution even though the underlying cause is a change in atmospheric dynamics.
  • Climate change also affects emissions from natural sources. For example, when temperatures rise in forest areas, you will have higher emissions of volatile organic compounds. These compounds can produce tropospheric ozone. This has nothing to do with traditional pollutants; it is linked to natural processes that are being altered by climate change. These feedbacks also need to be taken into account.
  • Another issue is that when designing air quality policies, we need to be mindful that some policies may have negative implications for the climate. For example, efforts to control particulate matter in the atmosphere can have unintended effects on the climate. Removing all aerosols is very good for air quality and human health, but aerosols also have a cooling effect on the climate. If they are removed entirely, that may have consequences for the climate system. These interactions, therefore, need to be carefully considered.
  • Another point I would like to stress relates to monitoring. I noticed in the report a strong emphasis on the importance of monitoring networks for air pollution, and that is indeed a very powerful statement. Monitoring is essential because it enables compliance. Without reliable monitoring, you cannot verify whether policies are working.
  • However, monitoring should not be left to polluters themselves, because they may have an interest in misrepresenting their emissions. We have seen similar issues in the area of carbon dioxide removal. In the most recent reports on carbon dioxide removal, we found that there are more than one hundred different protocols for verifying removal. That makes it impossible to compare actions and assess effectiveness. This shows why standardized approaches are essential.
  • At WMO, we are developing good practice guidelines for monitoring air pollution. We have documents that explain how to measure tropospheric ozone, nitrogen oxides, volatile organic compounds, and other pollutants. These standards should be implemented consistently, and the value of international standards for monitoring and reporting should be clearly emphasized.
  • Another area concerns extreme events and forecasting. WMO operates standardized systems for forecasting phenomena such as sand and dust storms. These systems can be used to support transboundary forecasting and early warning. We also have operational systems for forecasting biomass burning events. Globally, there are already several centers producing operational products that support this work.
  • This also raises questions about responsibility. For example, if a country experiences a sand and dust storm, who is responsible? In such cases, we need to look at broader frameworks, such as the Convention to Combat Desertification, to understand the drivers behind the increasing intensity of these events. In many cases, these are not directly linked to industrial pollution but to environmental degradation and changing natural sources of emissions.
  • Communicating the links between air pollution, human health, and climate change is essential. Based on our global monitoring network, WMO publishes an annual Air Quality and Climate Bulletin. This bulletin examines global average levels of pollutants such as PM2.5, PM10 and tropospheric ozone and explains their connections with climate processes.
  • Overall, this is a very strong report. Strengthening the discussion on the interconnectedness between air quality and climate would make it even stronger. And from our side, WMO stands ready to continue providing the technical standards and scientific support needed for this work.

Emiline PLUCHON | Environmental Affairs Expert, United Nations Economic Commission for Europe (UNECE)

  • From our perspective, advancing regional and international cooperation is absolutely essential. The Convention on Long-range Transboundary Air Pollution has been very successful over the past years, and we believe it is important to share the lessons learned from this convention with other regions. This can help others understand what has worked and what has not worked and possibly improve their own regional and national frameworks.
  • For UNECE, one of the most important elements of the convention is the strong science-policy interface that has developed over time. The Convention includes several bodies, including those that look specifically at the impacts of air pollution on ecosystems, human health, and vegetation. This provides a very strong scientific basis and foundation for the work carried out under the convention.
  • This is one of the most important aspects that could be replicated elsewhere, and it is also something that was mentioned in the report.

Dharmesh SHAH | Consulting Senior Campaigner, Center for International Environmental Law (CIEL)

  • The report makes a powerful case that air pollution is not only an environmental issue but also a profound public health issue and a human rights challenge. Many of us working in this space already know the scale of the problem, but seeing the data captured in a Special Rapporteur’s report is extremely important. The number of premature deaths each year, the impact on vulnerable populations, and the fact that these impacts are disproportionately borne by those most vulnerable all need to be highlighted.
  • In many ways, and this is something we see not only in India but globally, the air pollution crisis is often treated as a technical problem of emissions and monitoring. But in reality, it is a crisis of political choices — choices about energy systems, industry, development models, and ultimately about whose health we are willing to sacrifice.
  • I would like to highlight a few issues that deserve further attention, partly drawing from the experience in India but also from broader global trends.
  • First, we need to move beyond symptom-based responses and focus on the structural drivers of air pollution. In many cities, especially in the Global South, we see emergency responses when pollution events occur. These include water sprinkling, water vapor guns, smoke towers, or temporary traffic restrictions. These measures create the appearance of action but do not address the underlying drivers of pollution.
  • Seasonal emergency responses often coexist with continued dependence on coal power, expanding vehicle fleets, insufficient attention to public transport, and growing petrochemical infrastructure, which is directly connected to the plastics crisis. The report also mentions petrochemical corridors in the United States, but these issues are not limited to certain countries. Even in developed countries, there are significant challenges associated with this kind of industrial development.
  • Air pollution is deeply embedded in energy systems, industrial policy and economic models that prioritize certain types of growth over public health. That is really the crux of the problem.
  • Turning to microplastics, this is an issue that deserves greater attention. Plastic particles are entering our bodies through the food we eat, the water we drink, and, importantly, through the air we breathe. Microplastics have already been detected in human lungs, blood, and even placenta tissue.
  • The important point is that these particles are rarely just plastic. They often carry toxic additives, including endocrine disruptors, heavy metals, and flame retardants, which are used in plastic production. They can also absorb other pollutants present in the air. In effect, microplastics can act as vectors that deliver toxic chemicals into the human body.
  • Exposure to these pollutants is highly unequal. Workers are often on the front line of this exposure, including those in plastic production facilities, recycling plants, waste management facilities, and the informal sector, particularly waste pickers in many countries. These groups face significantly higher exposure to microplastics and related pollutants, making this a very important aspect of the air pollution discussion.
  • Another critical area that CIEL has been working on is fertilizers. In particular, ammonia emissions from fertilizers and livestock play a major role. Agriculture accounts for a large share of global ammonia emissions, and ammonia reacts in the atmosphere to form fine particulate matter, known as PM2.5.
  • In regions such as Europe, the United States and large parts of Asia, ammonia emissions contribute significantly to particulate pollution. Unfortunately, we are likely to see these emissions increase in the future as fertilizer use intensifies. There is also a connection here to petrochemicals, since many fertilizers are derived from petrochemical processes.
  • The key point is that agricultural pollution is often overlooked because it occurs outside urban areas. However, the health impacts of fertilizer-related air pollution travel far beyond rural regions. We therefore need interventions that address fertilizer management, nutrient efficiency, and the potential co-benefits that can arise from these changes.
  • Finally, I want to return to an issue that was mentioned earlier by the Special Rapporteur: data democracy and access to information. This is a very important issue, particularly in many democracies around the world. The report rightly emphasizes the importance of monitoring and public access to air quality information. However, in many countries, particularly in the Global South, the governance of pollution data itself has become a political issue.
  • There have been instances where monitoring stations are switched off during peak pollution events, poorly maintained, or where pollution data is delayed or selectively disclosed. Monitoring networks are often too limited to capture pollution hotspots affecting vulnerable communities.
  • When information about pollution is controlled, incomplete or inaccessible, frontline communities lose their ability to understand the risks they face, demand accountability, and push for regulatory action.
  • At the same time, community-led monitoring initiatives demonstrate how citizen-generated data can strengthen accountability. But ultimately, regulatory agencies and monitoring systems must also be held accountable and made as transparent as possible.
  • In the context of clean air governance, we need open, transparent, and verifiable monitoring systems that empower communities and enable oversight.
  • I will conclude with two brief recommendations. First, regulatory frameworks should recognize microplastics and airborne plastic particles as emerging environmental health risks and adopt precautionary measures. Second, air pollution strategies must incorporate agri-food systems, including measures to reduce ammonia emissions from synthetic fertilizers and livestock through improved nutrient management and support for agroecological farming.

Astrid PUENTES RIAÑO | UN Special Rapporteur on the Right to a Healthy Environment

  • The report is really just the tip of the iceberg. It was a way to bring together information.
  • When we talk about clean air, we often talk about very technical and scientific information, but we are also talking about human rights. That is why I decided to present this report here in Geneva, at the Human Rights Council, because we need to strengthen the human rights perspective on this issue.
  • In another part of my professional life, I worked with an organization that litigated one of the cases that was later decided by the Inter-American Court of Human Rights, the case of La Oroya. I experienced firsthand what happens with air pollution there. La Oroya is a city in Peru where a smelter has been operating since 1922, so it represents more than a century of environmental and health impacts. The smelter has been private at some points, public at others, and then private again.
  • As several of you mentioned, access to information was extremely difficult. At the beginning, Peru did not even have air quality standards. Later, there were national standards, but they did not include limits for emissions from the smelter.
  • Air quality monitoring was also very limited. Monitoring was conducted monthly or annually, but it did not capture pollution spikes. In that case, in Peru, the main problems were sulfur dioxide and arsenic emissions. What this illustrates is the importance of having science-based information and of prioritizing the people most affected.
  • Unfortunately, in La Oroya, people had to go to the doctor repeatedly because of exposure, but there were no toxicologists in the public health system. And again, I do not think this situation is unique to Peru.
  • Another problem was that people did not have access to their own medical records unless they had a lawyer. I experienced this directly. These are the kinds of situations that show why access to information, monitoring, and legal accountability are so important.
  • This also relates to the challenge of controlling business activities. This is not a political agenda; it is a challenge that states themselves constantly raise. We need to find ways to balance these issues while strengthening accountability and advancing solutions.
  • Dharmesh mentioned plastics, and in the past years we also saw that even scientists involved in negotiations were harassed. We need to find ways to address these kinds of pressures. Again, this is not about political affiliation or ideology. It is a human rights issue.
  • As Oksana also mentioned, and I have seen this firsthand in Mexico City, climate change is increasing air pollution. There are many things that we already know, but there are also many things we still do not know. That is where the precautionary principle becomes important, as well as an intersectional approach that places children and other vulnerable populations at the center.
  • We need to advance accountability, strengthen legislation, and improve monitoring of business activities. This is essential becausethere are many issues connected to industries such as fossil fuels, plastics, and recycling. These activities often create significant risks both for workers and for surrounding communities.
  • This issue touches on many elements of the rule of law and democratic governance. My hope is that this report can serve as a way to highlight these interconnections, but also as an opportunity to continue conversations and to build bridges between different communities and sectors so that we can advance solutions on the ground.
  • This is not something that the mandate alone can solve, but hopefully it can help support and facilitate these discussions.

Q&A

  • One issue that came to my mind, and which I am not sure is addressed in the report, concerns shipping. Globally, shipping is enormous. Around 800 million container shipments move through global maritime trade every year. When we look specifically at waste shipments, which are particularly relevant for the BRS conventions given their focus on the transboundary movement of waste, these activities are associated with significant emissions. Estimates suggest that around 14 to 15 million tons of CO₂ are produced each year from the transport of these shipments.
  • I am therefore curious to hear the views of the panelists on this issue. In particular, whether controls on the transboundary movement of waste have an impact on air pollution and whether this aspect should perhaps be addressed more explicitly as a separate point in reports or in policy discussions related to clean air actions.

Astrid PUENTES RIAÑO | UN Special Rapporteur on the Right to a Healthy Environment

  • Shipping is definitely a very important sector. The issue is so broad that I did not have the opportunity to expand on it fully in the report.
  • Ports and the areas where shipping activities take place, where vessels enter and leave, are often pollution hotspots and need to be addressed as a priority. For example, when a port is expanded, the decisions and licenses associated with that expansion should include comprehensive environmental, social, and human rights impact assessments. This also connects with another report that I prepared.
  • Within those assessments, we need to consider climate emissions across all scopes. Scope 1 refers to the direct emissions from activities taking place at the port itself. Scope 2 includes emissions associated with related energy use and transportation. Scope 3 covers the entire value chain, including upstream and downstream transport. States must consider all these emissions when assessing shipping-related activities.
  • How states account for shipping and aviation emissions. I included some discussion of this in the report based on a country visit to Singapore, but the issue applies to all countries. States should include shipping and aviation emissions fully and comprehensively in their national emissions inventories and in their nationally determined contributions (NDCs). Unfortunately, we have seen challenges in this area. For example, the strategy that was agreed last year through the International Maritime Organization for reducing emissions did not go as far as many had hoped.
  • This connects to the broader point about incorporating a human rights–based approach. What I hope from this report, and even more from discussions like this, is that the human rights perspective is not confined to Geneva or the Human Rights Council. Instead, it should be integrated across the work of international organizations, secretariats and UN agencies such as UNEP, WMO, UNICEF, and UNDP.
  • Using the human right to a healthy environment as a core element means ensuring access to information, participation, and accountability. If we do not even have access to reliable information about emissions from sectors like shipping, it becomes very difficult to understand their impacts or to hold actors accountable. And we already know that these impacts are significant.
  • Science recently showed that one of the planetary boundaries that has already been crossed is ocean acidification. This illustrates that these issues are all interconnected. Climate, air pollution, shipping, and ecosystems are not separate problems. They are part of the same system. That is why we need to continue these multidisciplinary conversations.

Intervention from the floor – Weenarin LULITANONDA | Co-founder of the Thailand Clean Air Network

  • There is a growing trend where many countries, especially developed countries, no longer want to host large numbers of data centers because of the enormous energy and water demands they require. As a result, many of these projects are increasingly being relocated to developing countries.
  • I’m from Thailand, and what we are seeing there is exactly this shift. Companies are coming and proposing large data center projects, and the government is often very welcoming and generous in opening the door to them. But the scale of the resources required is huge. Thailand still relies on around 70% fossil fuels for its energy production. When you think about the electricity demand of these massive facilities, the amount of pollution that could result is significant.
  • Then there is the issue of water use. Data centers require enormous quantities of water for cooling systems. This raises serious questions about whether there will even be enough drinking water available for communities in the long term.
  • Often, when people talk about artificial intelligence and digital technologies, they focus on the benefits and the innovation. But they rarely talk about the environmental costs, the energy consumption, the emissions, and the water use required to maintain these infrastructures.
  • It is an important aspect that deserves much more attention in discussions about air pollution, energy systems, and environmental impacts.
